LuxAeroExchangeLuxAeroExchangeMarketplace role. LuxAeroExchange is a listings and communications platform only. We do not act as a broker, dealer, or agent in any transaction. All sales, negotiations, and agreements are conducted privately between buyer and seller unless both parties opt into platform-managed escrow services.
FAA data. FAA Registry data shown on listings is sourced from public FAA releases and may be delayed or incomplete. LuxAeroExchange does not guarantee the accuracy or timeliness of FAA data. For certified records, order directly from the FAA. Fees may apply.
Seller disclosures. Sellers are solely responsible for accurate disclosure of known damage, maintenance history, and inoperative items. LuxAeroExchange does not verify such disclosures. Buyers are strongly encouraged to conduct independent pre-buy inspections.
Pre-buy inspections. Requests are routed to sellers and, where available, to partnered A&P/IA providers. Availability, quality, and pricing of such services vary by location and are outside LuxAeroExchange’s control.
Fees and listings. LuxAeroExchange offers FREE listings. The free listing includes publication with up to ten (10) photos. Pricing and included features are promotional and may be changed or discontinued at LuxAeroExchange’s discretion on a prospective basis. For a limited time only, LuxAeroExchange will offer free listings. Free listings can be removed at any time by LuxAeroExchange or by the user. Photos more than 10 are an additional $0.50 each and videos are $0.50 for the first video and $1.00 for the 2nd video. LuxAeroExchange has the right to change pricing at any time. LuxAeroExchange will never charge for a pre-existing listing unless additions are added.
Optional upgrades. Sellers may purchase add-ons at checkout or thereafter, including (i) Boosting (temporary prominence in browse results), (ii) additional photos above ten (10), and (iii) video hosting/embedding. Upgrade fees are charged at purchase and are non-refundable once the upgrade is delivered.
Listing duration and inactivity. Listings do not automatically expire. However, LuxAeroExchange may remove, archive, or unpublish any listing that is inactive for more than six (6) months. “Inactive” may include, without limitation, no edits or renewals by the seller, invalid or bouncing contact information, or lack of response to buyer inquiries or platform notices. LuxAeroExchange may make a reasonable attempt to notify the account email before removal.
General. Taxes and payment-processing charges (if any) are the seller’s responsibility. LuxAeroExchange may refuse, edit, or remove any listing that violates these Terms, our policies, or applicable law. Nothing herein guarantees any minimum level of exposure, impressions, or sales results.
Prohibited content. Fraudulent, misleading, infringing, or illegal content is strictly prohibited. We reserve the right to remove any listing, message, or account that violates these terms without prior notice.
Limitation of liability. To the maximum extent permitted by law, LuxAeroExchange, its owners, affiliates, officers, directors, employees, contractors, and agents shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages, including but not limited to loss of data, loss of profits, business interruption, reputational harm, or personal injury, arising from or in connection with: (i) use of the platform; (ii) inability to access the platform; (iii) reliance on any listing, communication, or content; (iv) any transaction or dispute between users; or (v) any third-party service or link accessed through the platform. All services are provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to merchantability, non-infringement, or fitness for a particular purpose. Users acknowledge that their sole and exclusive remedy for dissatisfaction is to discontinue use of the platform.
Indemnification. Users agree to indemnify, defend, and hold harmless LuxAeroExchange and its affiliates, officers, directors, employees, and agents from any claims, demands, losses, liabilities, damages, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to: (i) user content or listings; (ii) use or misuse of the platform; (iii) transactions with other users; or (iv) violation of these Terms & Conditions.
Governing law and jurisdiction. These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of law principles. Any dispute, claim, or proceeding shall be brought exclusively in the state or federal courts located within Lowndes County, Georgia, and users consent to the personal jurisdiction of such courts.
Reservation of rights. LuxAeroExchange reserves the right to modify, suspend, or discontinue any feature, service, or promotional offering at any time, without notice or liability. Continued use of the platform after updates constitutes acceptance of the revised Terms.
Amendments. These Terms & Conditions may be updated from time to time. Users are responsible for reviewing them periodically. Continued use of the platform constitutes acceptance of any changes.
